Prerequisites and/or Corequisites
Prerequisites: Contracts I, Contracts II, History and Philosophy of Law I, History and Philosophy of Law II, Torts and the Process of Law I, Torts and the Process of Law II

Students who have successfully completed 730-112 Dispute Resolution and Legal Ethics or 730-383 Professional Conduct or 730-383 Legal Ethics and Professional Conduct will not be allowed to study this subject.


Description

The subject will introduce to students the theoretical and practical issues relating to legal ethics and dispute resolution. Students will acquire an understanding of the moral foundations of legal ethics, and will learn how to identify and resolve ethical issues that arise in the dispute resolution context. The focus will be on non-litigation dispute resolution processes, particularly negotiation and mediation. Students will have the opportunity, through simulations and role plays, to learn how to use negotiation and mediation skills effectively. Ethical topics studied will include the ethical duties owed by lawyers to the law, the court, and their clients, conflicts of interest, confidentiality and professional responsibilities related to trust accounts.
