Description

This subject further develops the study of law begun in History and Philosophy of Law I. It provides both an introduction to some of the contemporary and critical theories of law, and an overview of the institutions and processes that construct contemporary law in Australia. In addition, it further enhances the skills of reading, writing and speaking law.

Part one provides an introduction to the course by revising and extending the examination of the Western liberal tradition of law that was encountered in HPL 1. Part two is concerned with a number of critical theories of law: these include the various Marxisms and the study of the ideology of law; feminisms and their study of the gendered nature of law; and poststructuralisms and their study of performance of law. Part three moves from the conceptual to the institutional level of law. It considers the institutions and processes of law in Australia. It is organised around concrete case studies of the process of legislation, the process of adjudication and the process of regulation.
