Prerequisites and/or Corequisites
Prerequisite: Torts and the Process of Law IDescription
Students in Torts and the Process of Law II critically evaluate the elements in the tort of negligence, drawing from and building upon some of the Case Studies considered in Torts and the Process of Law 1. Topics include the duty to take care, breach of that duty, causation, remoteness, damage, damages assessment, wrongful death and vicarious liability.
Students also will discuss reforms relating to alternative forms of accident compensation, and consider the views and critiques of commentators, including feminist legal scholars, and those who might be charactarised as critical legal studies advocates.
This subject develops the skills students acquired in the Torts and the Process of Law 1. In the course of examining negligence law and avenues for reform, this subject, like TPL 1, considers the ways in which the legal process operates, with detailed application of the common law principles, statutory regimes and their interaction.
